Who You're Talking To

Real estate expertise built for complicated situations.

I'm Caleb Goforth, a licensed North Carolina real estate broker based in Marion. I work specifically with heirs, executors, and families dealing with inherited property — situations where the title is cloudy, the estate was never opened, or the family can't agree on what to do next.

This isn't general real estate. I understand the probate process, the NC intestate succession statutes, partition law, and how to navigate situations that most agents and buyers won't touch. I also work with foreclosure attorneys, probate attorneys, and title companies who handle these cases every day.

Whether you want to sell quickly, protect the equity, or just understand what your options are — I'll tell you what's actually possible for your specific situation.

Situations We Handle

Inherited property is rarely simple.

Every situation is different. Here are the most common ones we help with across Western NC and beyond.

No Will — Heirs by Law

When a parent dies without a will, property passes to heirs under NC intestate succession (G.S. Ch. 29). We help you understand what that means and what steps are required to clear the title and sell or keep the property.

Multiple Heirs Who Disagree

When siblings or co-owners can't agree, the threat of a partition lawsuit follows. Under NC's Uniform Partition of Heirs Property Act, every heir has rights. We help negotiate solutions before it gets to court.

Property in Foreclosure

Inherited a home that's already behind on the mortgage or in active foreclosure? There's often significant equity worth protecting — but the window to act is short. We know the foreclosure timeline and exactly when to move.

No Probate Was Opened

The person passed, no estate was ever opened, and now the property is stuck in limbo. We help coordinate probate attorneys to open the estate properly so the title can be cleared and the property can close.

Out-of-State Heirs

You inherited property in NC but live somewhere else. We handle the local coordination — deed research, attorney introductions, title work, inspections — so you don't have to travel to resolve it.

Cloudy Title & Liens

Old judgments, tax liens, deceased owners still on the deed, unprobated estates in the chain — we do curative title work and can still close when traditional buyers and agents walk away.

Real Outcomes

What families say after working with us.

★★★★★

"My mother passed without a will and the house had been in foreclosure for months. Caleb knew exactly what needed to happen, got the estate opened, and we closed before the auction. I didn't even have to come down from Virginia."

D. Whitfield · Buncombe County, NC
★★★★★

"Three of us inherited the property and we could not agree. Caleb sat down with all three of us separately, laid out exactly what a partition lawsuit would cost and take, and within two weeks we had a deal everyone could live with."

R. Thomas · McDowell County, NC
★★★★★

"The title had problems going back 30 years — quit claims, a deed from a deceased owner, unpaid taxes. He found the attorneys who knew how to fix it and still got us a cash offer. I had no idea that was even possible."

M. Patterson · Burke County, NC

Your Options

Two paths. You choose.

We lay out every option honestly — including whether selling even makes sense for your situation.

If you want to sell

Exit with what the estate is worth.

  • Direct cash offer — fast, certain closing

  • Probate attorney coordination included
  • Title issue resolution before closing
  • Fair division negotiated between heirs
If you want to keep it

Protect it. Clean up the title. Keep the equity.

  • Mortgage reinstatement coordination
  • Probate opening to clear title for financing
  • Partition negotiation — avoid forced court sale
  • Tax lien resolution and payment plan referrals
  • Attorney referrals for probate and estate matters

The Process

From confusion to clarity.

Most people we talk to have never dealt with inherited property before. Here's exactly what happens when you reach out.

Common Questions

What heirs ask us most.

It depends on how the property was owned. In NC, a property owned solely by one person with no surviving spouse generally needs probate to clear the title for a sale. If the property passed by tenancy by the entirety or had a named beneficiary, probate may not be required. We'll tell you exactly what applies to your situation and can connect you with the right attorney.
This is extremely common. Under NC law (G.S. 46A, the Uniform Partition of Heirs Property Act), any heir can eventually force a partition sale through the courts — but that's rarely the best outcome for anyone. We work to negotiate a solution all parties can live with before it gets there, and typically that results in a cleaner sale and more money than a court-ordered partition produces.
Usually, yes — but timing is everything. NC foreclosure under power of sale (G.S. Ch. 45) has a defined process with multiple steps, and there are windows to reinstate, negotiate, list, or pursue excess proceeds. The sooner you call, the more options stay open. Call us directly rather than filling out the form if foreclosure is active.
There is no cost to have an initial conversation about your situation. If we move forward with a cash purchase, we cover closing costs. If we list the property through our licensed brokerage, standard commission applies — which is disclosed upfront before you sign anything. There are never hidden fees and you're under no obligation at any point.
Yes — curative title work is one of our core specialties. We've worked properties with deceased owners still on the deed, unprobated estates in the chain of title, old judgments and tax liens, and quit claims that created ownership gaps. We know which title attorneys handle these cases and we've closed properties other buyers refused to touch.
Yes. We regularly work with out-of-state heirs. We handle local deed research, attorney coordination, inspections, and title work on your behalf. Most transactions close with electronic signatures and remote notarization. You typically don't need to travel to NC to resolve it.

Waiting makes it harder.

Foreclosure timelines move fast. Estate delays compound. The options available today may not be there in 60 days. A conversation costs nothing.
